Dispute Resolution Standards
Chapter 1: General Provisions
Article 1 (Purpose)
The Dispute Resolution Standards (hereinafter referred to as "the Standards") are established in accordance with Article 20(3) of the Act on Consumer Protection in Electronic Commerce to provide clear guidelines for resolving disputes arising from e-commerce transactions or intermediated sales conducted through My Korea Mall Co., Ltd. (hereinafter "the Company").
Article 2 (Definitions)
For the purpose of these Standards, the following definitions apply:
"E-commerce" refers to direct electronic transactions, as defined in Article 2(2) of the Act on Consumer Protection in Electronic Commerce.
"Intermediary E-commerce" refers to an e-commerce intermediary service, as defined in Article 2(4) of the Act on Consumer Protection in Electronic Commerce.
"Seller" refers to any business entity conducting transactions with Members through intermediary services provided by the Company for the purpose of selling goods or services.
"Member" refers to an individual who has entered into an agreement with the Company and utilizes its services, in accordance with Article 2(5) of the Act on Consumer Protection in Electronic Commerce, which defines consumers.
"Counterparty" refers to individuals who engage in transactions with Sellers via the Company’s intermediary services but do not fall under the definition of "Consumer" in Article 2(5) of the Act on Consumer Protection in Electronic Commerce.
Article 3 (Scope of Application)
① These Standards shall apply to disputes between the Company and Members, as well as disputes between Sellers and Members (hereinafter referred to as "Consumer Disputes"). ② Unless explicitly stated otherwise, these Standards shall also apply to disputes between the Company and Counterparties, as well as Sellers and Counterparties (hereinafter referred to as "Counterparty Disputes").
Article 4 (Amendment of the Standards & Relation to Other Agreements)
① The Company may amend these Standards within the legal limits set by the following regulations:
Act on Consumer Protection in Electronic Commerce
Act on the Regulation of Terms and Conditions
Act on the Promotion of Information and Communications Network Utilization and Information Protection
Framework Act on Consumers and other applicable laws.
② If these Standards do not cover a specific issue related to Consumer Disputes or Counterparty Disputes, the following agreements shall apply:
My Korea Mall’s Terms of Use (for Members)
If the issue is not covered by either document, relevant legal provisions shall apply.
③ In case of any conflict between the Standards, My Korea Mall’s Terms of Use, and the Seller Agreement Terms, the following hierarchy shall apply:
